Terms & Conditions

These Terms and Conditions constitute a legally binding agreement between you (the mosque administrator or user) and Homemade Designs (operating as My Mosque). By registering, accessing, or using the My Mosque platform, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, please do not use the platform.

1. Definitions

  • Platform refers to the My Mosque website (www.mymosque.in), mobile applications, and all related services.
  • We / Us / Our refers to Homemade Designs, operating the My Mosque platform.
  • You / Your refers to the mosque administrator or any individual using the platform.
  • Mosque Account refers to the registered account created by a mosque administrator on the platform.
  • Subscription refers to the paid or free plan selected by the mosque administrator to access platform features.
  • Services refers to all features and functionalities provided through the platform.

2. Eligibility and Account Registration

2.1 Who Can Register

  • Be at least 18 years of age.
  • Be an authorised representative of the mosque — such as an imam, treasurer, secretary, or committee member — with authority to bind the mosque to these terms.
  • Provide accurate, complete, and current information during registration.
  • Have a valid mobile number and email address for account verification.

2.2 Account Responsibility

  • Maintaining the confidentiality of your account login credentials.
  • All activities that occur under your account.
  • Notifying us immediately at mymosque.43@gmail.com if you suspect unauthorised access.
  • Ensuring that all information entered into the platform is accurate and kept up to date.

2.3 One Account Per Mosque

Each mosque may have only one primary registered account on the platform. Multiple administrator roles may be added within a single mosque account depending on the subscription plan.

3. Platform Services

3.1 What We Provide

  • Donation recording, receipt generation, and financial reporting.
  • Expense tracking and payroll management for mosque staff.
  • Member directory and due tracker.
  • Prayer time management and Azan alert notifications.
  • Madrasa, Idgah, and Maktab educational management module.
  • Imam meal tracker with rotation management.
  • My Mosque Feed — a private community communication channel.
  • Zakat calculator, event planning tools, and smart financial reports.
  • Multilingual support: Assamese, Bengali, Hindi, and English.

3.2 Service Availability

We aim to keep the platform available 24/7 but do not guarantee uninterrupted access. The platform may be unavailable due to scheduled maintenance (we will provide 24 hours notice where possible), unplanned technical issues, or circumstances beyond our reasonable control. We are not liable for any loss or inconvenience caused by platform unavailability.

3.3 Feature Changes

We reserve the right to add, modify, or remove features from the platform at any time. We will provide reasonable notice of significant changes. Your continued use of the platform after such changes constitutes acceptance of the modified services.

4. Subscription Plans and Payment

4.1 Plans Available

My Mosque offers Free, Standard, and Pro subscription plans. Details of current features and pricing are available at www.mymosque.in/pricing. Pricing is subject to change with prior notice.

4.2 Free Plan

The Free Plan is available for a period of six months from the date of mosque registration. It is intended as a trial to evaluate the platform. The Free Plan is available once per mosque and cannot be renewed or extended.

4.3 Paid Subscriptions

Paid subscriptions are available on monthly and annual billing cycles. By subscribing, you authorise us to charge the applicable fee through Razorpay or Paytm to the payment method you provide.

4.4 GST

All subscription fees are subject to 18% Goods and Services Tax (GST) as applicable under Indian law. GST invoices will be issued to your registered email address upon each payment.

4.5 Cancellation and Refunds

Cancellation and refund terms are governed by our Refund and Cancellation Policy, which forms part of these Terms and Conditions.

5. Acceptable Use Policy

5.1 Permitted Use

You may use the My Mosque platform solely for lawful mosque management purposes, including recording donations, managing members, tracking expenses, and communicating with your mosque community.

5.2 Prohibited Use

You must not use the platform to:

  • Violate any applicable Indian or international law or regulation.
  • Enter false, misleading, or fraudulent information into the platform.
  • Impersonate any person or mosque or misrepresent your authority to act on behalf of a mosque.
  • Collect or store personal data of individuals without their knowledge or consent.
  • Attempt to gain unauthorised access to other mosque accounts or platform systems.
  • Reverse engineer, decompile, or attempt to extract the source code of the platform.
  • Use the platform for any commercial purpose other than managing your own mosque.
  • Upload or transmit any content that is defamatory, offensive, or promotes hatred or discrimination.

5.3 Consequences of Violation

We reserve the right to suspend or terminate your account without notice if we reasonably believe you have violated this Acceptable Use Policy. We may also report violations to relevant authorities where required by law.

6. Donation and Payment Features

6.1 Donation Recording

My Mosque provides tools for mosque administrators to record donations received from community members. The platform acts as a record-keeping tool only. My Mosque does not collect, hold, or transfer donation funds on behalf of any mosque.

6.2 UPI Payments

The platform provides UPI QR code generation and UPI deep link features to facilitate direct payments from donors to the mosque's own UPI account. All such payments are made directly between the donor and the mosque — My Mosque is not a party to these transactions and is not responsible for any failed, delayed, or disputed payments.

6.3 No Payment Aggregator

My Mosque does not hold, aggregate, or transfer funds on behalf of mosques or donors. We do not operate as a payment aggregator and are not required to hold a payment aggregator licence from the Reserve Bank of India for the features provided on this platform.

7. Data and Privacy

Your use of the platform is also governed by our Privacy Policy, which forms part of these Terms and Conditions.

7.1 Your Data Responsibility

  • Obtaining appropriate consent from mosque members before entering their personal information into the platform.
  • Ensuring that member data entered is accurate and kept up to date.
  • Using member contact details only for legitimate mosque communication purposes.
  • Complying with applicable data protection laws including the Digital Personal Data Protection Act, 2023.

7.2 Data Ownership

All data entered into the platform by a mosque administrator remains the property of the mosque. My Mosque processes this data solely to provide the platform services. We do not use mosque-specific data for advertising, profiling, or any purpose other than service delivery.

8. Intellectual Property

8.1 Our Intellectual Property

The My Mosque platform, including its design, features, code, content, branding, logo, and documentation, is the intellectual property of Homemade Designs. All rights are reserved. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our prior written consent.

8.2 Your Content

You retain ownership of all content and data you enter into the platform. By entering content into the platform, you grant us a limited, non-exclusive licence to process and store that content solely for the purpose of providing the platform services to you.

8.3 Trademark

My Mosque is a trademark of Homemade Designs. You may not use the My Mosque name, logo, or branding without our prior written consent.

9. Third-Party Services

The platform integrates with the following third-party services to provide certain features:

  • Razorpay — for subscription payment processing.
  • Paytm — for alternative subscription payment processing.
  • WhatsApp Business API — for automated notifications to mosque members and staff.
  • Google Firebase — for push notifications and crash reporting.

Your use of these third-party services through the platform is subject to their respective terms of service. We are not responsible for the availability, performance, or practices of these third-party services.

10. Limitation of Liability

Important

To the maximum extent permitted by applicable Indian law, My Mosque and Homemade Designs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Specifically, we are not liable for:

  • Loss or corruption of data entered into the platform due to technical failure.
  • Financial loss arising from errors in donation records, expense records, or financial reports generated by the platform.
  • Disputes between mosque administrators and mosque members regarding donations or financial matters.
  • Failed UPI payments or disputes between donors and mosques.
  • Actions of third-party service providers including Razorpay, Paytm, and WhatsApp.

Our total aggregate liability for any claim arising from the use of the platform shall not exceed the total subscription fees paid by you in the three months immediately preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Homemade Designs, its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms and Conditions.
  • Your violation of any applicable law or regulation.
  • Your misuse of the platform or its features.
  • Any content you enter into the platform that infringes the rights of a third party.
  • Any dispute between you and your mosque members arising from your use of the platform.

12. Account Suspension and Termination

12.1 Termination by You

You may terminate your mosque account at any time by contacting us at mymosque.43@gmail.com. Termination is subject to our Refund and Cancellation Policy for any active paid subscription.

12.2 Termination by Us

We may suspend or terminate your account with or without notice if you violate these Terms, your subscription payment fails and is not resolved within 7 days, we are required to do so by law, or we reasonably believe your account is being used for fraudulent purposes.

12.3 Effect of Termination

  • Your access to the platform will cease immediately.
  • Your mosque data will be retained for 30 days, during which you may request an export.
  • After 30 days, all your mosque data will be permanently deleted.
  • Financial records required to be retained by law will be kept for the legally required period.

13. Disclaimers

The My Mosque platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • The accuracy, completeness, or reliability of financial reports generated by the platform.
  • The suitability of the platform for any particular mosque's needs.
  • The accuracy of prayer times provided by the platform — prayer times are indicative and should be verified with local religious authorities.
  • The uninterrupted availability of the platform.

My Mosque is a management tool. It does not provide religious, financial, legal, or tax advice. Mosque administrators should consult qualified professionals for such matters.

14. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. When we make material changes, we will notify you by:

  • Email to your registered email address.
  • In-app notification on the My Mosque dashboard.
  • Updated terms on www.mymosque.in/terms with a revised effective date.

Your continued use of the platform after the effective date of any changes constitutes your acceptance of the revised terms. If you do not agree with the revised terms, you must stop using the platform and may terminate your account.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and other applicable Indian legislation.

15.2 Dispute Resolution

In the event of any dispute arising from these Terms and Conditions, both parties agree to first attempt to resolve the dispute amicably through direct communication. If the dispute cannot be resolved within 30 days, it shall be referred to the exclusive jurisdiction of the courts of Karimganj, Assam, India.

16. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy and Refund and Cancellation Policy, constitute the entire agreement between you and My Mosque regarding use of the platform.
  • Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these terms without our prior written consent. We may assign our rights to a successor entity.
  • Language: These terms are written in English. In the event of any inconsistency between an English version and a translated version, the English version shall prevail.
